1  Custom-Ordered Tours Contract

 Custom-Ordered Tours Contract (hereinafter referred to as the "Contract") is the Contract that Luxurique Travel Inc. (hereinafter referred to as the "Company") will, at the request of the customer, prepare a travel plan that specifies the destination and itinerary of the trip, the details of transportation and other services that the customer is entitled to receive, and the amount of the trip fee to be paid by the customer to the Company, and will execute the trip accordingly.

 

2  Application for a Contract

(1) The customer who wishes to apply for the Contract concerning the contents of the planning document delivered by the Company to the customer shall fill in the prescribed items on the application form prescribed by the Company and submit it to the Company together with an application fee in an amount separately determined by the Company.

 

(2) The Company may accept applications for tours on the condition that "the Company will receive payment of the tour fee and cancellation fee, etc. without the Member's signature (hereinafter referred to as "correspondence contract") from credit card companies affiliated with the Company (hereinafter referred to as "Members").  Customers who wish to conclude a correspondence contract with the Company are requested to provide the Company with their "credit card name," "membership number," "card expiration date," etc.

 

(3) Please enter your name as it appears on your ID (passport, etc.).

 

If a customer's name is entered incorrectly, or if the customer's name changes due to marriage, etc., it may be necessary to cancel a ticket that has been reserved or issued, or to issue a new seat reservation or ticket, or to arrange a new cabin after canceling a previously arranged cabin.

 

In addition, even if a new seat or room is secured, if the applicable fares or charges are different, the difference between the newly applicable fares or charges and the fares or charges of the transportation or accommodation agency pertaining to the cancellation, as well as the cancellation charges imposed by the transportation or accommodation agency, shall be borne by the customer.

 

Please note that we may ask you to cancel the tour contract if we are unable to arrange new seats or rooms due to the availability of seats or rooms at the transportation or accommodation facilities. In this case, we will charge a cancellation fee as specified by us.

 

(4) When we receive an application for a trip from a person responsible for the Contract as a 

representative of the customers who comprise the group or groups, we deem that the person responsible for the Contract has all the rights of representation regarding the conclusion and cancellation of the contract, etc.

 

(5) The person responsible for the Contract must submit a list of constituents to the Company by the date determined by the Company.

 

(6) The Company shall not be liable for any debt or obligation that the person responsible for the contract now owes or may be expected to owe to the constituents in the future.

 

(7) If the person responsible for the Contract does not accompany the group/groups, we will deem a member of the group/groups appointed by the person responsible for the contract in advance to be the person responsible for the contract after the commencement of the tour.

 

(8) Please inform us if you are a. in poor health, b. physically disabled, c. pregnant, d. an assistance dog user, or require any other special consideration. We will comply with such requests to the extent possible. Any costs incurred for special measures taken by the Company for the customer based on the customer's request shall be borne by the customer.

 

3  Refusal to Enter Into a Contract

The Company may refuse to enter into a contract in the following cases:

(1) When the customer intends to conclude a communication contract and is unable to settle all or part of the obligations related to the tour price in accordance with the credit card terms and conditions of the partner credit card company due to the invalidity of the customer's credit card or other reasons.

 

(2) When a customer is found to be a Bouryokudan member, a Bouryokudan-related person, or other anti-social force.

 

(3) When the customer is likely to cause inconvenience to other travelers or interfere with the smooth implementation of group activities.

 

(4) When it is necessary for the Company's business.

 

4 Time of Conclusion of Contract

(1) The contract is concluded when the Company accepts the conclusion of the contract and receives the application fee.

 

(2) When concluding a contract with a person responsible for the contract, the Company may accept an application for a contract without receiving payment of an application fee by a special written agreement. In this case, the contract will be executed at the time of delivery of such special agreement document.

 

(3) The application fee shall be applied to the tour fee, cancellation fee, and any other money the customer pays to the Company.

 

(4) A travel contract by correspondence contract shall be concluded when the notice of acceptance of the conclusion of the travel contract from the Company reaches the customer. (The "date of credit card use" in the case of a correspondence contract is the date on which the Member and the Company should fulfill payment or refund obligations for the tour fee, etc. based on the custom-ordered tour contract, and in the case of the former, the date the contract is concluded, and in the case of the latter, the date on which the member requests cancellation of the contract).

 

(5) If the customer wishes to pay by credit card and the credit card company is unable to settle the payment, the customer will be deemed not to have applied for the service.

 

5 Delivery of Contract Document

(1) Promptly after the conclusion of the contract, the Company shall deliver to the customer a contract document describing the itinerary, contents of tour services, tour fee and other tour conditions, and the Company's responsibilities.

 

(2) In the event that the Company delivers the contract document, the scope of tour services that the Company is obligated to arrange and manage the itinerary under the contract shall be as set forth in the contract document set forth in the preceding paragraph.

 

6 Confirmation Document

(1) In the event that the contract document is unable to describe the confirmed itinerary or the names of transportation or accommodation facilities, the contract document shall list the names of the accommodation facilities to be used and the names of transportation facilities that are important for description, then after the delivery of such contract document, the Company shall deliver a Confirmation Document by the date up to the day before the tour start date (or the tour start date if the application for the contract is made on or after the seventh day counting back from the day before the tour start date).

 

(2) In the case of the preceding paragraph, if the Company receives an inquiry from a customer who wishes to confirm the status of arrangements, the Company shall respond to it as promptly and appropriately as possible, even before the delivery of the Confirmation Document.

 

(3) In the event that the Company delivers the Confirmation Document, the scope of the tour services for which the Company is obliged to arrange and manage the itinerary shall be specified in the said Confirmation Document.

 

7 Time of payment of tour fee and change of tour fee

(1) The amount of the tour fee will be stated in the written plan of the Order-taking type tour. (2) The tour fee must be paid by the date specified by the Company before the departure date of the tour.

 

(2) If the applicable fares and charges of the transportation services to be used are revised significantly beyond the extent that is normally expected due to significant changes in economic conditions, etc., as of the reference date stated in the tour plan document, the tour fee may be increased or decreased by the difference. In the event that the Company increases the tour fee, the Company shall notify the participant 15 days prior to the day before the departure date of the tour, and in such case, the participant may cancel the contract without paying the tour planning fee or cancellation fee prior to the commencement date of the tour. If the applicable fares and charges are reduced, the tour fee will be reduced by the difference.

 

(3) In the event that the Company has stated in the contract document that the tour fee varies depending on the number of persons using transportation and accommodation facilities, etc., and the number of persons using such facilities changes due to reasons not attributable to the Company after the contract is concluded, the Company may change the amount of the tour fee in accordance with the terms and conditions stated in the contract document.

 

8 Change of Contractual Terms and Conditions

(1) When a customer requests a change in the contents of the contract, the Company shall comply with the customer's request to the greatest extent possible. In such cases, the Company may change the tour fee.

 

(2) In the event of a natural disaster, war, riot, suspension of travel services by transportation or accommodation agencies, orders by government authorities, provision of transportation services not in accordance with the original operation plan, or other reasons beyond the Company's control, if the Company has no choice but to make such changes in order to ensure the safe and smooth implementation of the tour, the Company will promptly notify the customer in advance and may change the tour itinerary, contents of tour services, and other contents of the tour contract by explaining to the customer the reasons why the Company could not be involved and the causal relationship between such reasons and the tour.  However, in case of emergency, if it is unavoidable, the Company will provide an explanation after the change has been made.

 

9 Customer Replacement

(1) The customer may, with the Company's consent, transfer his/her contractual position to another person or change the constituent person. In such case, a fee for such substitution as determined by the Company shall be charged. (If a ticket has already been issued, you may be charged a separate fee for re-ticketing.)

 

(2) Notwithstanding (1) above, we reserve the right to refuse to replace a customer due to reasons such as the transportation and accommodation facilities used not accepting the replacement of the customer.

 

10 Cancellation of Travel Contract

(1) Cases in which a cancellation fee is charged by the customer

① The customer may cancel the tour contract by paying the cancellation fee stated in the tour plan document.

 

② Cancellation due to reasons such as loans and travel procedures that are not the responsibility of the Company shall also be subject to the cancellation fee shown in the attached table.

 

③ If it is found that the customer falls under 3 (2), the Company may cancel the tour contract. In such case, the Company shall charge the planning fee or cancellation fee stated in the planning document.

 

(2) Cases in which no cancellation fee is charged by the customer

The customer may cancel the contract without paying a cancellation fee prior to the commencement of the tour in the following cases

 

①When the contents of the contract have been changed by the Company; provided, however, that such 

change is limited to those listed in the left column of the following table or other important changes.

 

②When the tour fee is increased in accordance with 7(2).

 

③In the event of natural disaster, war, riot, suspension of provision of travel services by transportation or accommodation agencies, orders by government authorities, or other reasons that make or are extremely likely to make the safe and smooth implementation of the tour impossible.

 

④When the Company has not delivered the Confirmation Document to the customer by the due date

 

⑤When it becomes impossible to implement the tour in accordance with the tour itinerary described in the contract document due to reasons attributable to the Company

 

⑥ If, after the tour has commenced, the customer is unable to receive the tour services described in the contract document due to reasons not attributable to the customer or if the Company so informs the customer, the customer may, notwithstanding the provisions of (1) above, cancel the contract for the portion of the tour services that the customer is unable to receive without paying any planning fee or cancellation fee.  In such case, the Company shall refund to the customer the amount of the tour fee for the portion of the tour services which the customer is no longer able to receive.

 

⑦The Company shall refund to the customer the amount of the portion of the tour service for which the customer is unable to receive a refund, less the amount of cancellation fees, penalty charges and other expenses already paid or to be paid for the tour service (unless such expenses are due to reasons attributable to the Company).

 

11 Our Responsibility

(1) The Company will compensate for any damage caused to the passenger by the intentional or negligent act of the Company or its agents. However, the Company will compensate for the damage only if the Company is notified of such damage within two years from the day following the day on which the damage occurred.

 

(2) The Company shall not be liable to compensate for any damage incurred by the customer due to natural disasters, war, riot, suspension of travel services by transportation or accommodation facilities, orders by government authorities, or other reasons beyond the control of the Company or its agents, except in the case of (1) above.

 

(3) The Company shall compensate up to ¥150,000 per passenger (except in the case of willful misconduct or gross negligence on the part of the Company) for damage to baggage, provided that the Company is notified of such damage within 14 days, starting from the day following the date of occurrence of such damage.

 

12 Special Compensation

In accordance with the Special Compensation Regulations attached to the General Terms and Conditions of the Travel Agency (Custom-Ordered tour contract), we will pay the following compensation to the customer for certain damages to life, body, or baggage caused by sudden and accidental external accidents while the customer is participating in this tour:

15,000,000 yen for death compensation, 20,000 to 200,000 yen for hospitalization, 10,000 to 50,000 yen for outpatient visits, depending on the number of days of hospitalization or outpatient visits, and 150,000 yen for damage to personal belongings (however, the maximum compensation for one item or one pair of items is 100,000 yen).

 

In the event that the itinerary specifies a date on which the customer will not receive any travel services arranged by the Company (according to the standard time of the travel destination), if such date is specified in the contract document, the Company shall not pay compensation or compensation for any damage to life, body or baggage caused by an accident on such date.

 

13 Itinerary Guarantee

If any of the changes listed in the following table is made to the itinerary, compensation for the change will be paid according to the contents of the change multiplied by the rate specified in the following table in accordance with the provisions of the General Terms and Conditions of Travel Agency Business (part of the contract for Order-Taking Type Tours); however, the amount of compensation for the change paid for one tour contract shall be limited to 15% of the tour fee. If the amount of compensation for change is less than 1,000 yen for one tour contract, no compensation for change will be paid.

The Company shall not pay compensation for change if the cause of the change in the contract listed in the left column of the following table is due to any of the followings.

 

①Natural disaster ②War ③ Riots ④Orders from public offices ⑤Cancellation of travel services provided by transportation agencies, such as flight cancellations, service interruptions, and holidays

⑥Provision of transportation services not in accordance with the original operation plan, such as delays, changes in transportation schedules, etc.

⑦Measures necessary to ensure the life or physical safety of customers 

⑧Changes at the request of the customer

(Note 1) In the above table, " Before the tour starts " means the case where the relevant change is notified to the Company by the day before the commencement of the tour, and " After the tour starts " means the case where the relevant change is notified to the operator on or after the day of commencement of the tour.(Note 2) In the event that a Confirmation Document has been issued, the term "Contract Document" shall be deemed to be replaced with "Confirmation Document" and this schedule shall apply. In this case, if there is any discrepancy between the contents of the Contract Document and those of the Confirmation Document or between the contents of the Confirmation Document and the tour services provided, such discrepancy shall be treated as one case for each change.(Note 3) In the event that the transportation service for the change described in item ③ or ④ involves 

the use of an accommodation facility, such change shall be treated as one case per night.

 

(Note 4) The change in the name of the company of the transportation service listed in item ④ shall not apply when the change involves a change to a higher grade or higher equipment.

 

14 Customer's Liability

(1) In the event that the Company suffers damages due to the intentional or negligent act of the customer, the Customer shall compensate the Company for such damages.

 

(2) The Customer shall endeavor to understand the rights and obligations of the customer and other details of the tour contract described in the contract document by utilizing the information provided by the Company.

 

(3) If, after the commencement of the tour, the Participant recognizes that the tour services described in the contract document differ from those described, the customer shall promptly notify the Company or the tour service provider thereof at the tour site.

 

15 Accident Reporting

In the event of an accident or other incident during the tour, please notify us immediately at the contact point provided in the final itinerary. (If there are circumstances that cannot be notified, please notify us as soon as the circumstances are no longer applicable.)

 

16 Purpose of Use of Personal Information and Provision to Third Parties

(1) The Company shall use the personal information provided in the application form submitted at the time of application for the tour for the purpose of communication with the customer, to the extent necessary for the arrangement of the services provided by the transportation and accommodation agencies, etc., and for the procedures for receipt of such services, or to the extent necessary for the procedures for insurance to cover the liability of the Company under the tour contract and expenses incurred in the event of an accident, etc. In addition, we will provide your name, passport number, etc. to the transportation and accommodation agencies and insurance companies, etc. by sending them your name, passport number, etc. by electronic means, etc. in advance to the extent necessary for the procedures for insurance to cover our liability under the travel contract and expenses in the event of an accident, etc.

 

(2) Among the personal data of customers held by the Company, the Company will share with its group companies the minimum range of personal data necessary to contact customers, such as name, address, telephone number, or e-mail address. The Company's group companies may use such personal data for the purpose of providing information on their respective business, events, etc., and shipping purchased products.

 

17 Compliance with the General Terms and Conditions

Matters not described in this written explanation of travel conditions shall be governed by the Standard General Conditions of Travel Agency Business (Order-Taking Type Organized Tour contract section).
